Tipologie di servizi erogati dal sito

I “Canali Tematici” sono di Due categorie:

• Pubblici, per i quali è sufficiente un “click” sull’apposito tasto per esservi inserito come Utente,

• Privati, per i quali la richiesta di adesione deve essere autorizzata dal Promotore e responsabile del Canale Tematico.

Quindi i “Canali Tematici” sono di 4 tipologie:

• Canali Pubblici;

• Canali Privati;

• Canali Pubblici Qualificati

• Canali Privati Qualificati

ai quali va aggiunto un quinto canale

• Canale Commerciale

Le informazioni redatte nell’ambito di qualunque tipologia di canali, possono essere “duplicate” e presentate su una mappa generale per uso commerciale (Canale Commerciale).

L’informazioni diffusa attraverso il Canale Commerciale potrà avere anche valenza temporanea, e verrà inserita nella mappa su richiesta del Promotore del Canale Tematico all’Amministrazione del Sito

Il “Canale commerciale”, aperto a tutti gli utenti, utilizza strumenti di selezione che ne semplificano l’uso in presenza di molti POI e che rendono facilmente accessibili tutte le informazioni ivi residenti.

Condizioni d’uso

Responsabilità generali riguardanti tutti i fruitori del sito WA

I fruitori dei servizi del sito WA devono agire nel rispetto delle norme riguardanti:

• la sicurezza

• la privacy

• il copy right,

• le licenze di pubblicazione (ad esempio di tipo GNU)

• la pubblicità,

• la proprietà intellettuale,

• la concorrenza

In particolare, i fruitori dei servizi devono dichiarare di avere letto e di conoscere le norme sulla privacy contenute sul presente sito.

Il gestore del sito si riserva di chiudere Canali Tematici o di escludere singoli membri, a proprio insindacabile giudizio, senza obbligo di preavviso e senza oneri o responsabilità di alcun genere.

Ciascun Utente o fornitore di informazione attraverso il sito Walking About è responsabile dell’uso diretto o indiretto di informazioni mendaci o distorte da lui redatte e nell’accettare il presente Regolamento esenta il gestore del sito stesso da ogni responsabilità, in particolare da quelle derivanti dalla localizzazione di persone o cose sul territorio, informazioni che non devono essere trasferite in alcun modo a soggetti terzi e devono essere in ogni caso distrutte entro 24 ore salvo specifici accordi fra utente e erogatore di informazioni georeferenziate rispetto all’utente.

Gli Utenti possono chiedere informazioni e indicazioni dirette e in tempo reale agli membri dei Canali Tematici di appartenenza, attraverso internet, sia da postazioni fisse o mobili, ad esempio tramite smartphone, per essere aiutati nella preparazione alla fruizione del territorio, sia nel corso della fruizione stessa, nonché successivamente, mediante l’utilizzazione dei dati personali registrati, ad esempio quelli geodetici.

Tali dati verranno gestiti nel rispetto della legge e, in particolare, nel rispetto delle norme sulla privacy e sotto la totale loro responsabilità.

Non potrà essere comunicata ad alcuno la posizione della persona sul territorio, neanche approssimativamente né in modo retroattivo, se non autorizzata esplicitamente dallo stesso utente.

L’unico soggetto abilitato a far conoscere la propria posizione è l’utente, che potrà manifestarsi presente sulla mappa - attraverso il proprio terminale portatile - ai membri di un Canali Tematici di cui fa parte o a tutti, tramite le mappe dei Canali Tematici Pubblici

Ogni eventuale controversia verrà esaminata presso il Foro di Roma.

1. Responsabilità connesse alla creazione di Canali Tematici, alla partecipazione agli stessi, alla erogazione e fruizione delle informazioni ivi circolanti.

Tutti possono accedere ai Canali Tematici Pubblici pertanto, al fine di assicurare il rispetto della legge, della privacy e delle comuni regole del vivere civile, il Promotore di un Canale Pubblico dovrà essere molto chiaro nella descrizione dei

• dei temi trattati

• dei criteri di scelta dei redattori

• delle autolimitazioni che disciplina la redazione dei contenuti

In particolare, dovrà essere messa in chiara evidenza la eventuale scelta di assegnare il ruolo di redattore a chicchessia in modo che agli utenti non possa sfuggire che si tratta di un canale con un basso livello di controllo di qualità.

In ogni caso il Promotore del Canale è responsabile dell’andamento complessivo del Canale, quindi dovrà eseguire monitoraggi periodici e provvedere a proprio insindacabile giudizio, alla sospensione o alla cancellazione delle funzioni di Redattore (vedi “User Manual”), nonché alla sospensione o alla cancellazione dei POI contenenti informazioni lesive dei diritti di terzi.

Il Gestore del sito Walking About non avrà alcuna responsabilità in eventuali contenziosi fra Promotore del Canale e i Redattori, in particolare sulla proprietà dei contenuti da essi erogati a scopo di lucro o a titolo volontario. La declaratoria del Canale Tematico dovrebbe contenere elementi della sua policy nei rapporti fra Utenti, Redattori e Promotore del Canale

I Canali Pubblici consentono l’accesso in modo automatico, senza nessuna condizioni aggiuntive.

Chi accede viene indicato come Utente del Canale Tematico e fa parte di una elenco pubblico.

Gli Utenti dovranno eseguire una attenta analisi delle declaratorie e non accedere a canali che non abbiano requisiti lesivi della propria persona. Qualora per errore o per carenza della declaratoria del canale un utente dovesse registrarsi o abbonarsi ad un Canale sbagliato, deve cancellarsi immediatamente con gli strumenti automatici messi a sua disposizione

Gli strumenti automatici per la propria cancellazione da un Canale Tematico sono a disposizione di tutti gli aderenti al Canale, anche del Promotore del Canale che tuttavia con la propria cancellazione provoca la cancellazione del Canale. (vedasi “User Manual” Cancellazione trasferimento, di POI e di Canali).

I partecipanti a Canali Tematici Pubblici nel sottoscrivere le norme generali per una corretta gestione delle informazioni, riportate nel paragrafo 1) “Responsabilità generali”, liberano il gestore del sito Walking About da ogni responsabilità rispetto a tutti i danni che Utenti, Redattori, Assistenti (addetti alla assistenza diretta degli utenti vedi “User Manual”), Promotori dei Canali o terzi possano subire nel corso dei loro rapporti.

Le responsabilità connesse alla gestione e all’uso dei canali privati, sono le stesse di quelle relative ai Canali Pubblici, alle quali occorre aggiungere:

Da parte dell’utente la presa d’atto di eventuali vincoli alla partecipazione richiesti dal “Promotore del Canale Tematico Privato”, come ad esempio l’accesso ai soli maggiorenni, l’appartenenza alla propria famiglia, l’iscrizione ad una associazione o a un partito ecc.

Da parte del Promotore del Canale Tematico Privato una chiara descrizione degli scopi del Canale Tematico e della sua natura “privata“, cioè a chi viene dedicato, la valutazione delle richieste di adesione e la comunicazione dell’esito della richiesta.

2. Responsabilità connesse alla creazione di Canali Tematici Qualificati, partecipazione agli stessi, erogazione e fruizione delle informazioni ivi circolanti

Le responsabilità connesse alla gestione dei Canali Tematici Qualificati sono le stesse di quelle relative ai Canali Tematici non qualificati con l’aggiunta gli obblighi derivanti dalla applicazione del “Regolamento per la Qualificazione dei servizi informativi erogati da Canali Tematici o Assistenti Qualificati”.

Le prescrizioni del regolamento sono nella logica dell’autocertificazione e consistono essenzialmente in informazioni e dati forniti dal Promotore del Canale Tematico, dai Redattori e dagli Assistenti agli utenti i quali si basano su di esse per accordare la loro fiducia al Canale Tematici Qualificato.

Le responsabilità del Promotore del Canale Tematico Qualificato, dei Redattori e degli Assistenti sono relative a tali informazioni che dovranno essere veritiera, non ingannevoli, complete e trasparenti.

Tali criteri dovranno essere accuratamente applicati nel fornire alcune informazioni particolarmente importanti ai fini della qualificazione del canale tematico. In particolare quelle relative a:

• il curriculum del Promotore del Canale Tematico e i suoi titoli istituzionali, quando opera per mandato della sua amministrazione aziendale;

• la qualificazione di tale curriculum con informazioni rintracciabili e riscontrabili

• i criteri adottati per la qualificazione delle informazioni erogate dal Canale Tematico Qualificato

• La pubblicazione del curriculum qualificato dei Redattori e degli Assistenti

Il Gestore del sito Walking About si riserva di declassare, sospendere o cancellare quei Canali Tematici che a suo insindacabile giudizio non hanno comportamenti conformi al “Regolamento per la Qualificazione dei servizi informativi erogati da Canali Tematici o Assistenti Qualificati”. Tali azioni non potranno comportare alcun contenzioso fra il gestore del sito, e gli altri operatori (Promotore del sito, Redattori, Assistenti e Utenti).

Nessuna responsabilità o coinvolgimento del gestore del sito Walking About potrà essere evocata per il declassamento, la sospensione o la cancellazione di Canali Tematici su richiesta delle autorità superiori.

Per fare parte di Canali Tematici Qualificati è necessario essere autorizzati dal gestore del Canale Tematico inviandogli una apposita richiesta. Il gestore del Canali Tematici Qualificati ha la facoltà di accettare la richiesta di iscrizione e di cancellare l’iscrizione al Canale Tematico stesso in caso di inadempienze alle regole definite.

I gestori dei Canali Tematici Qualificati assumono la responsabilità della qualificazione delle informazioni ivi circolanti, attraverso l’accettazione esplicita delle norme regolamentari sottopostegli nel sito WA.

Ciascun Canali Tematici Qualificati viene reso noto a tutti sul sito WA, rendendo anche note tutte le informazioni sulla base delle quali detta qualificazione è avvenuta.

Il gestore del sito WA si riserva di non attivare un Canale Tematico ove le informazioni acquisite, ad insindacabile giudizio dello stesso gestore, siano ritenute insufficienti o non coerenti con le finalità del social network o nel caso in cui il suddetto impegno non sia stato sottoscritto o non sia ritenuto idoneo.

Al fine di promuovere lo sviluppo di Canali Tematici Qualificati gestiti da gruppi qualificati coesi - rilevanti per il loro apporto di valore aggiunto in termini di credibilità e di qualità della informazione – si evidenzia la responsabilità in solido oltre che individuale del Promotore del Canale Tematico Qualificato, dei Redattori e degli assistenti.

Pertanto il gestore del sito Walking About sospenderà le attività dei Canali Tematici Qualificati presso i quali dovessero emergere contenziosi interni circa la coerenza dei contenuti e della gestione di tali gruppi.

3. Procedure per l’attivazione di servizi informativi commerciali o pubblici (e gratuiti)

A tal fine il gestore del Canali Tematici potrà posizionare sul territorio, sotto la propria responsabilità, punti informativi virtuali che verranno fruiti dall’utente sia in fase di progettazione dei propri spostamenti sia un fase di fruizione del territorio.

I punti informativi potranno contenere informazioni commerciali oltre che culturali e di utilità pubblica.

Nell’ambito del Canale Tematico potrà essere dato supporto agli utenti per via sia telefonica, sia telematica, sia convenzionale.

Il costo dell’erogazione dei servizi - ove questi siano a pagamento - dovrà essere congruo con le tariffe di mercato di servizi analoghi o simili.

L’uso del sito è gratuito per la diffusione delle informazioni personali e - a titolo promozionale, per un anno dall’inizio dell’attività - anche per la diffusione delle informazioni commerciali.

I Promotori di Canali Tematici che vogliano fornire servizi informativi commerciali o servizi informativi pubblici o privati con e senza scopo di lucro per assistere gli Utenti sul territorio in tempo reale, ad esempio nella preparazione e nel corso di un percorso o viaggio, sottoscrivono con la accettazione della presente licenza d’uso una liberatoria formale per il gestore del sito di coinvolgimento e responsabilità in tali attività e la sua totale estraneità nell’uso illegittimo o improprio del sito stesso, dei danni derivanti dall’uso delle informazioni erogate attraverso il sito o dagli eventuali disservizi o guasti delle reti, degli apparati, del software e più in generale per tutti i servizi erogati da terzi attraverso il sito Walking About.

4. Prerogative del Gestore del sito Walking About

Il gestore del sito Walking About si riserva di declassare, sospendere o cancellare quei Canali Tematici e i POI commerciali o quant’altro che a suo insindacabile giudizio non sia conforme alla sia contro della presente Licenza d’uso non hanno comportamenti conformi al “Regolamento per la Qualificazione dei servizi informativi erogati da Canale Tematico o Assistenti Qualificati”. Tali azioni non potranno comportare alcun contenzioso fra il gestore del sito, e gli altri operatori (Promotore del sito, Redattori, Assistenti e Utenti).

Nessuna responsabilità o coinvolgimento del gestore del sito potrà essere evocata per il declassamento, la sospensione o la cancellazione di Canali Tematici su richiesta delle autorità superiori.

The “Walking About Services improves your online experience by offering you access to a variety of features, offerings and content. In addition, many software versions provided by “WALKING ABOUT” (e.g. the “WALKING ABOUT” instant messaging software and the Compad instant messaging software) ("Software") are configured to automatically report back information relating to computer errors arising in connection with use of the Software, without notice to you. Information on your Software configuration settings may be included. This data is sent to “WALKING ABOUT” to help us diagnose performance issues with, and improve, the Software.

How Your “WALKING ABOUT” Services Information is Used

Your “WALKING ABOUT” Services Information is used to:

• Operate and improve the Software, Web sites, services and offerings available through the “WALKING ABOUT” Services;

• Provide to you personalized content and advertisements;

• Fulfill your requests for products, programs, and services;

• Communicate with you and respond to your inquiries;

• Conduct research about your use of the “WALKING ABOUT” Services; and

• Help offer you other products, programs, or services that may be of interest to you.

Your “WALKING ABOUT” Services Information will not be shared with third parties unless:

• You have published such information in Public Areas (as defined below).

• We have your prior consent to disclose such information;

• We need to disclose such information to fulfill a transaction you have requested;

• We are required to disclose such information to authorized officers of the court in order to comply with valid legal process or to act in other urgent circumstances (as further specified below)

• We need to send such information to a company which works on behalf of “WALKING ABOUT” in helping us provide our services to you. In such circumstances we will only provide these companies with the information they need to deliver the service and they will only be permitted to use such data on our request and in accordance with our instructions; and

• You provide information to another party through the “WALKING ABOUT” Services which is "Co-Branded" with a third party. Any information you choose to provide on a "Co-Branded" page or through a "Co-Branded" service will be handled by either party and in accordance with this Privacy Policy and the third party privacy policy. A "Co-Branded" page or service is a page or service which bears both the “WALKING ABOUT” and third party names, branding, graphics or anything else which makes it clear you are viewing a Co-Branded service. “WALKING ABOUT” may use agents and contractors in order to help operate the “WALKING ABOUT” Services. You should also note that “WALKING ABOUT”'s operational personnel may be occasionally exposed to random usage traffic going through the “WALKING ABOUT” servers.

In the event that ownership of the “WALKING ABOUT” Services was to change as a result of a merger, acquisition or transfer to another company, your “WALKING ABOUT” Services information may be transferred.

Direct Marketing

During registration to the “WALKING ABOUT” Services and at other times during your use of the “WALKING ABOUT” Services you may be asked if you would like to receive various promotional offerings from “WALKING ABOUT”. Direct Marketing does not apply to communications and information sent by “WALKING ABOUT” (whether by email, through the Software, or other means) that is directly related to your registration with the “WALKING ABOUT” Services and the various features (including notifications of new features) contained within the “WALKING ABOUT” Services, or the fulfillment of a specific transaction you have requested (for example, a service advisory from the “WALKING ABOUT” Services, or an acknowledgment of a purchase order). Please note if you have chosen to use a version of the Software Co-Branded with a third party, Direct Marketing shall not apply to communications and information sent by such third party through the Software that is directly related to your registration with the third party's services and the various features (including notifications of new features) provided to you by such third party, or the fulfillment of a specific transaction you have requested (for example, an acknowledgment of a purchase order). In addition, Direct Marketing does not apply to advertisements provided to you through the “WALKING ABOUT” Services, including from “WALKING ABOUT” business partners. These business partners and advertisers receive aggregate data about groups of users, but do not receive information that personally identifies you, except if otherwise agreed by you.

Public Areas and My Details Area

If you use the “WALKING ABOUT” Services to disclose information about yourself publicly, for example, in or through: chat rooms, message boards, groups, lists, blogs, “WALKING ABOUT” directories, your My Details Area (as defined below) or any other area reasonably understood to be a public area (collectively, the "Public Areas"), other online users may obtain access to and use any such information you provide. You should therefore carefully consider whether you wish such information to be accessible by others. You should also note that others may be able to record certain information even if not made available in a Public Area, such as the content at a session (e.g. instant messages) or your IP address. The IP address is an integral part of the TCP/IP standard protocol of the Internet and can be extracted by any party to the communication session using certain software and/or hardware.

The My Details Area is the area on “WALKING ABOUT” that users are able create a personal profile for themselves by providing various details about themselves. Users may add details to the My Details Area during registration or any time thereafter through the Software or the “WALKING ABOUT” Web sites. You may be required to provide a nickname and/or email address (which will be displayed in the My Details Area) that will be used as your “WALKING ABOUT” identifier (e.g. your login name which may be used by others to locate you on “WALKING ABOUT”). “WALKING ABOUT” does not require you to input any other personally identifiable information about yourself. Except if explicitly stated otherwise, any information you choose to provide in the My Details Area will be deemed to have been provided to a Public Area.

The holder of an “WALKING ABOUT” or Compad account and “WALKING ABOUT” or Compad password (as applicable) has the ability and discretion to edit the details provided in the My Details Area. For this reason and other reasons it is very important to keep your password in a safe place. It is your responsibility to keep your password and username secure. In some instances additions or amendments to your My Details Area may not be immediately visible to all users (e.g. users who already have that account on their contact list will be required to press "Update" in order to view the new or revised details or information entered).

Please be aware of where you choose to provide information. In certain Public Areas you may not be able to delete the information you have provided. For example, on message boards, chat sessions, or other services that are maintained by third parties (e.g. “WALKING ABOUT” lists, “WALKING ABOUT” Groups, “WALKING ABOUT” virtual private networks etc.).

Cookies and Web Beacons

The “WALKING ABOUT” Services may use cookies, web beacons, or similar technologies in combination with your “WALKING ABOUT” Services information to enhance and personalize your experience on the “WALKING ABOUT” Services, including, without limitation, to operate and improve offerings through the “WALKING ABOUT” Services; to help authenticate you when you use the “WALKING ABOUT” Services; to remember your preferences and registration information; to enable a shopping cart; to present and help measure and research the effectiveness of “WALKING ABOUT” Services offerings, advertisements, and e-mail communications (by determining which Network e-mails you open and act upon); and to customize the content and advertisements provided to you through the “WALKING ABOUT” Services.

A cookie is a small text file transferred from “WALKING ABOUT” to your computer that records information about your preferences and use of services provided by “WALKING ABOUT”. These providers may use cookies, web beacons, or similar technologies on your computer to help present, better target, and measure the effectiveness of their content and advertisements, using data gathered over time and across their networks of Web pages to determine or predict the characteristics and preferences of their audience. The “WALKING ABOUT” Services may share certain non-personally identifiable information about you as an “WALKING ABOUT” Services user (such as age or zip code) with certain ad network and service providers, including Advertising.com and TACODA, to help them deliver more relevant content and advertisements through their networks.
